The case involves a dispute over the burden of proof in a strict liability claim based on a design defect. The petitioners, Judith and Gary Shears, filed a lawsuit against Ethicon, Inc., and Johnson & Johnson, alleging injuries caused by Ethicon’s Tension-Free Vaginal Tape (TVT), a mesh sling used to treat stress urinary incontinence. The Shearses claimed that the TVT device was defectively designed. The case was then transferred to the United States District Court for the Northern District of West Virginia.The Supreme Court of Appeals of West Virginia was asked to clarify certain elements of proof required to establish a prima facie case in a strict liability claim based on a design defect. The court held that PJI § 411 does not correctly specify a plaintiff’s burden of proof in a strict liability claim based on a design defect. The court further held that a plaintiff asserting a strict liability claim for a design defect must prove that an alternative, feasible design was available to the manufacturer at the time the product in question was manufactured. Lastly, the court held that a plaintiff is required to prove that an alternative, feasible design existing at the time the subject product was made would have substantially reduced the risk of the specific injury suffered by the plaintiff. The case involves two petitioners, Daniel Dilly, Superintendent of the Rubenstein Juvenile Center (RJC), and Nancy Oldaker, Health Services Administrator at RJC, who were held in contempt of court by Judge Kurt Hall of the Circuit Court of Lewis County, West Virginia. The contempt charges arose from an incident involving a resident of RJC, identified as D.P., who suffered a broken jaw during a fight with other residents. The court had ordered that D.P. be taken off RJC grounds for an X-ray and that his mother be notified of his medical appointments. The court found that these orders were not adequately followed by the petitioners.The Circuit Court of Lewis County held a hearing to review D.P.'s placement and medical care, resulting in a "Medical Care Order" that directed RJC to schedule an appointment for D.P. with his oral surgeon and to allow D.P.'s mother to attend the appointment. The court also ordered RJC to provide a report concerning the incident that led to D.P.'s injury. When these orders were not fully complied with, the court held a "show cause" hearing and found both Superintendent Dilly and Ms. Oldaker in contempt of court, fining each of them $250.The Supreme Court of Appeals of West Virginia found that procedural errors in the lower court's contempt proceedings deprived the court of jurisdiction to impose such sanctions. The court noted that the lower court failed to provide the petitioners with adequate notice that they were facing indirect criminal contempt proceedings and did not afford them jury trials before imposing the fines. The court concluded that the contempt orders were void and granted the petitioners' requested writs of prohibition, thereby preventing the lower court from enforcing the contempt orders. This case involves a dispute between Blackrock Enterprises, LLC and BB Land, LLC and JB Exploration 1, LLC over a Lease Acquisition Agreement (LAA). Both parties claimed the other had breached the agreement and sought declaratory relief regarding their respective rights and obligations. The trial was bifurcated into two phases. In the first phase, a jury found that both parties had materially breached the LAA, but that Blackrock had committed the first material breach. As a result, the business court concluded that Blackrock could not recover for any subsequent breach committed by Jay-Bee. In the second phase, the business court determined that the parties were engaged in a de facto mining partnership and ordered Blackrock dissociated from the partnership. The court also valued Blackrock’s partnership interest at zero and ordered it to quit-claim its interests in certain leases to Jay-Bee. Blackrock appealed, arguing that the business court committed multiple errors in both phases of the proceedings.The Supreme Court of Appeals of West Virginia found that the business court erred in its construction of the first material breach doctrine and by granting judgment for Jay-Bee on the basis of clearly erroneous findings “deemed” made by operation of West Virginia Rule of Civil Procedure 49(a). The court reversed the final judgment and remanded for a new trial and further proceedings. Potomac appealed the decision, arguing that the lower court erred in several ways, including denying its pre-trial motion for summary judgment on the issue of whether Potomac is a “place of public accommodations” under the Human Rights Act, and admitting evidence at trial pertaining to the abuse of other children who resided at Potomac and the results of a 2014 investigation of that abuse.The Supreme Court of Appeals of West Virginia found that Potomac is not a “place of public accommodations” under the Human Rights Act and that the lower court erred by not granting summary judgment to Potomac on this issue prior to trial. The case revolves around a dispute over a deed reservation related to a shale pit on a property owned by the Hansen-Gier Family Trust. The deed, originally between the Haywoods and the Paughs, reserved the use of the shale pit for ingress and egress roads of "the development property." The Trust, the current property owner, sought a declaratory judgment that the reservation had fulfilled its purpose and is now void, or alternatively, that the reservation was limited to use on the ingress and egress roads of its property and two neighboring parcels. The Haywoods, however, argued that "the development property" meant any property they had developed or were going to develop.The Circuit Court of Mineral County ruled in favor of the Haywoods, interpreting "the development property" as any property the Haywoods develop. The court granted the Haywoods ownership rights to the shale and the right to remove the shale for property that they develop.The Supreme Court of Appeals of West Virginia reversed the lower court's decision. The Supreme Court found that the lower court's interpretation broadened the scope of the reservation beyond the language of the deed. The court also found that the lower court failed to consider the use-and-purpose limitation in the reservation, which specified that the shale could only be used for ingress and egress roads. The Supreme Court remanded the case for further proceedings, instructing the lower court to make additional findings consistent with the Supreme Court's interpretation of the reservation. The case involves T & C Construction Services and Theodore Miller (collectively, T & C), who operate a rental building in St. Albans, West Virginia. The City of St. Albans inspected the premises after a tenant reported a fire, revealing numerous fire hazards and building code violations. The City issued two citations for these violations, and the St. Albans Municipal Court fined T & C $81,250.00 for the fire code violations and $116,900.00 for the building code violations. After T & C failed to appeal these orders, the City sought enforcement in the Circuit Court of Kanawha County.The Circuit Court of Kanawha County issued a cease-and-desist order that enjoined T & C from operating its rental business on the premises, granted the City a money judgment for the criminal fines, and appointed a special commissioner to sell the property to satisfy the judgment. T & C appealed this enforcement order to the Supreme Court of Appeals of West Virginia.The Supreme Court of Appeals of West Virginia affirmed the lower court's decision to grant injunctive relief, rejecting T & C’s challenges to the injunctive relief. The court found that the lower court had jurisdiction to grant injunctive relief and did not abuse its discretion in doing so. However, the court reversed the lower court's appointment of a special commissioner to sell the property. The court held that the issuance and return of a writ of fieri facias showing “no property found” is a precondition to a circuit court’s jurisdiction to order the sale of a debtor’s property to satisfy a judgment for a criminal fine. Two campus police officers at Shepherd University, Jay Longerbeam and Donald Buracker, were terminated due to alleged "misconduct" and "unprofessionalism" during two incidents in 2018 and 2019. The officers claimed that their termination was a result of age and disability discrimination, retaliation under the West Virginia Human Rights Act (HRA), violation of the West Virginia Whistle-blower Law, and common law wrongful discharge. The Circuit Court of Jefferson County granted summary judgment against both officers on all claims.The officers appealed the decision, arguing that the lower court erred in finding no genuine issues of material fact and in its handling of the burden-shifting paradigm. They contended that their conduct during the incidents was legally proper and that the court failed to consider intervening acts of reprisal which were more temporally proximate to their protected activity than their discharge.The Supreme Court of Appeals of West Virginia found that the lower court erred in its handling of the "temporal proximity" issue and the burden-shifting paradigm. The court also found that the officers offered more than sufficient evidence upon which a rational trier of fact could find retaliatory motivation. Therefore, the court reversed the lower court's grant of summary judgment as to the officers’ whistle-blower and Harless claims and remanded for further proceedings. However, the court affirmed the lower court's grant of summary judgment as to Buracker’s HRA disability discrimination claim, finding his evidence insufficient to create an inference of disability discrimination. The Supreme Court of Appeals of West Virginia granted a writ of prohibition to defendant Denita D. Berg, preventing the Circuit Court of Grant County from enforcing orders to sell personal property before determining its ownership. The orders were part of a case brought by Denita Berg's stepchildren, who alleged that Berg had not properly inventoried their father's estate after his death and had committed fraud.The Supreme Court's decision was based on the fact that the orders to sell the property were issued despite the existence of genuine issues of material fact about who owned it. The Court explained that the circuit court's order was erroneous as a matter of law because it went beyond the requirements of Rule 56(c) of the West Virginia Rules of Civil Procedure. The case in question arose from a multi-million-dollar loss suffered by Westlake Chemical Corporation and Axiall Corporation (the respondents) at their chlorine manufacturing plant in Natrium, West Virginia. The loss occurred when 90 tons of liquid chlorine leaked from a rupture in a railroad tanker car that had been recently repaired by third-party contractors. The liquid chlorine vaporized into a cloud or plume that caused corrosion damage to the equipment at the plant. The respondents claimed the damage costs from their insurance companies (the petitioners). However, the insurance companies denied coverage based on three exclusions in the insurance policies relating to corrosion, faulty workmanship, and contamination. The case reached the Supreme Court of Appeals of West Virginia, which was asked to review three orders of the Circuit Court of Marshall County, West Virginia, Business Court Division. The lower court had granted partial summary judgment to the respondents, finding that none of the three exclusions barred the respondents’ coverage claims. The Supreme Court of Appeals of West Virginia concluded that the lower court's orders were not final orders subject to appeal at this stage of the proceedings. This was due to unresolved issues of causation and damages, and because the orders did not conclusively determine the disputed controversy, resolve an important issue completely separate from the merits of the action, or were effectively unreviewable on appeal from a final judgment. The Supreme Court dismissed this appeal of the circuit court's orders, the latter of which denied Appellants' motion for summary judgment, in this action alleging that Petitioners acted negligently in their handling of an incident where S.D. was inappropriately touched by a fellow student in the hallway of a high school, holding that the orders appealed from did not present an appealable ruling.In their notice of appeal, Petitioners asserted that the individual defendants were entitled to dismissal pursuant to W. Va. Code 29-12A-5(b)(2) because the order at issue found that the individual defendants did not act maliciously, in bad faith, or in a wanton or reckless manner. Petitioners further contend that the board of education was immune from liability pursuant to W. Va. Code 29-12A-5(a)(4). The Supreme Court dismissed the appeal, holding that the orders presented in this appeal were interlocutory, did not fall within the collateral order doctrine, and did not otherwise present an appealable ruling.
